ARG CNV issued, for public consultation, General Resolution 1015/2024 to regulate customer referrals, advertising channels, channeling of orders between platforms.
Background
Law 26.831 aims to develop the capital market and the regulation of the subjects.
As well as negotiable securities, with ARG CNV as enforcement and control authority.
ARG CNV is responsible for maintaining a registry, granting, suspending and revoking the operations authorization of registered agents, other natural and/or legal persons.
Digital technology forces financial market entities to transform and develop solutions.
The technological systems allow registered agents to offer services in a simple way.
Sometimes, these systems and their underlying economic contractual links are conducted with entities that are not under the regulatory scope of ARG CNV.
This makes it essential to update current regulations re means used to attract clients.
The advertising conducted by agents must be considered, as well as services offered.
It is necessary to update the regulations re modalities of contact with customers.
Also, it is essential to adapt regulations re means to report information to ARG CNV.
Highlights
Expanded proposal, considering provisions promoted to date by new management, technological developments, and time elapsed since Resolution 983, see #193108.
Proposed to modify the regulations applicable to agents registered in the Public Registry of ARG CNV and regulated by the provisions of Title VII of the Standards.
Proposal allows settlement and clearing agents (ALYCs) to get clients from platforms, payment service providers (PSPs), virtual asset service providers PSAVs, other ALYCs.
In turn, ALYCs can refer clients to PSAVs, PSPs, platforms and financial institutions.
Each actor will have a link, button to refer agents registered in ARG CNV or ARG CB.
The primary objective is to strengthen and simplify access to the financial system.
It also establishes guidelines that allow the standardization of basic regulatory elements re referrals, advertising channels, order fulfillment, and contact with clients.

Comments must be submitted within 15 business days, i.e., Sep. 18, 2024.
Effectiveness
General Resolution 1015 will come into force the day following its official publication.
