Rule Provisions
The finalized rule includes two new entries to the ITAR to expand the definition of the term activities that are not exports, reexports, retransfers, or temporary imports.
The taking of defense articles outside a previously approved country by armed forces of foreign government on a deployment is not an export, reexport, retransfer.
Foreign defense articles that enter US and are subsequently exported without modification or incorporation of US-origin defense articles are not subject to reexport.
