On Jul. 25, CSA issued notice re exemptions order for derivatives firms


  • CSA OSC, CSA Que, CSA NBW, CSA NVS, CSA Que, CSA ALB issued blanket-orders on temporary exemptions for obligations in NI 93-101 Derivatives: Business Conduct.
  • Coordinated Blanket Order 93-930, Temporary exemptions for derivatives firms from obligations when transacting with investment funds, and senior derivatives managers.
  • Follows the adoption of business conduct rule of dealers and advisers, see #126997.

  • Temporarily exempt derivatives firms from obligations when transacting with certain investment funds; senior derivatives managers from certain reporting obligations.
  • Ensure investment funds managed by investment fund manager, advised by adviser, that is foreign equivalent to Canadian registered investment fund manager or adviser.
  • Have same treatment as investment fund managed, advised as one regulated in CAN.
  • Extend the deadline for senior derivatives managers of derivatives dealers to prepare and submit a compliance report to their board of directors for the 2024 calendar year.
  • Effectiveness
  • Orders come into effect on Sep. 28, 2024, the same day as the Business conduct rule.
