Overview
On Jan. 29, 2024, the draft law was entered into the list of legislative and program works of the Council of Ministers under number UC6, and assumptions announced.
The bill was forwarded to the President and the Marshal of the Senate on Jul. 1, 2024.
Copyright and Digital Technologies
Bill 406 implements EU Directive 2019/789 laying down provisions relating to the exercise of copyright and related rights applicable to certain online broadcasts.
Also, EU Directive 2019/789 relates to those conducted by broadcasting organizations and television and for the rebroadcasting of television and radio programs.
POL PRL bill also aligns with DSM Directive 2019/790 on digital single market rights.
DSM directive is EU's response to current challenges related to the development of digital technologies in areas of copyright, and protecting copyright, accordingly.
This directive points out that rapid development of digital technologies is changing how works and protected subject matter are created, produced, distributed and exploited.
Also the DSM directive aims to address legal uncertainty for both copyright holders and users in relation to certain uses, including cross-border uses in digital environment.
Effectiveness
The Act shall enter into force one month after its announcement, except art. 1 point 21, which shall enter into force after 6 months from announcements.
Aug. 2024 Official Publication
On Aug. 19, 2024, POL GVT published Act of Jul. 26 amending Act on Copyright and related rights, Acts on Databases Protection, on Collective Management of Copyright.
Act shall enter into force after one month after publication i.e. on Sep. 19, 2024.
That is, with exception of art 1, point 24, in force after 6 months from publication.
