  • LOU LEG passed HB 200 to prohibit the recovery of past payments of workers' compensation premiums under certain circumstances; bill enacts LOU LEG 23:1172.3.
  • Bill Provisions
  • No insurer should be allowed to recover a past due payment of workers' compensation premium from an insured arising out of a claim for the misclassification of employee.
  • Unless insurer provides written notice to insured by certified mail, commercial courier, or via electronic transmission, within ninety days of completion of the payroll audit.
  • In event that insurer conducts a payroll audit, which shall serve as notice to insured, insurer to be prohibited from collecting additional workers' compensation premiums.
  • Insurer not allowed to modify a payroll audit more than 3 years after policy end.
  • Does not apply to misrepresentation of relevant information during prior audit, non-compliant payroll audit, payroll audit disputed by insured, review re fraud investigation
