On May 15, OKL LEG issued bill on storage of electronic insurance files
OKL LEG passed bill HB 3304 on delivery, storage of electronic insurance documents.
The bill amends OKL INS 36-123 on delivery and storage of electronic documents.
Bill Provisions
Plan sponsor of health benefit plan may, on behalf of covered persons enrolled in plan, provide consent to mailing of all communications related to plan by electronic means.
Before consenting on behalf of a covered person, a plan must confirm that covered person routinely uses electronic communications during normal course of employment.
And, inform party that such consent will be provided and that notices and documents related to the plan may be delivered to the party’s work electronic mail address.
When notice or document is provided electronically to party, insurer shall apprise party of significance of notice or document when it is not otherwise reasonably evident.
As well as of right to request and obtain a paper version of such notice or document.
