Aims to provide equity in coverage for mental health and substance use disorders.
Equitable Insurance Coverage
Amends The insurance code of 1956, MCH INS 500.100 to 500.8302 to add MCH LEG 3406hh to provide equity in coverage for mental health and substance use disorders.
Coverage must be similar to coverage for any other medical and surgical benefits.
The coverage must have no separate cumulative financial requirements that are applicable only with respect to mental health or substance use disorder benefits.
Nonquantitative treatment limitations may be imposed on both benefits only if the factors used are no more stringent than factors used for medical or surgical benefits.
Benefits must meet all applicable federal parity requirements, including, but not limited to, 42 USC 300gg-26 and the regulations promulgated under that section.
If a health insurance policy provides benefits through multiple tiers of in-network providers, health plan may divide its in-network benefits into tiered subclassifications.
