  • MD LEG approved Bill SB 0046 (HB 0143) re the unenforceability of contracts for the sale of condominiums that do not include statement re the presence of asbestos.

  • Amended Annotated Code of Maryland MD LEG 11-126(a), MD LEG 11-135(a)(5) and (g)(1) so that contract is only enforceable if it includes asbestos disclosure knowledge.
  • Sale contract must include a statement of whether the vendor/owner has knowledge about the presence of asbestos, its location and if/when an abatement was performed.
  • Must also include any violations of the health or building codes related to asbestos.
