MD LEG approved Bill SB 0046 (HB 0143) re the unenforceability of contracts for the sale of condominiums that do not include statement re the presence of asbestos.
Asbestos Disclosure
Amended Annotated Code of Maryland MD LEG 11-126(a), MD LEG 11-135(a)(5) and (g)(1) so that contract is only enforceable if it includes asbestos disclosure knowledge.
Sale contract must include a statement of whether the vendor/owner has knowledge about the presence of asbestos, its location and if/when an abatement was performed.
Must also include any violations of the health or building codes related to asbestos.
