OKL LEG passed bill HB 3318, to enact Prohibition of unfair service agreements act.
Adds new Section 301 of Title 16 in the Oklahoma Statutes as OKL LEG 16-310.
Bill Provisions
If a service agreement is deemed unfair under the act, it is unenforceable; no person shall record or cause to be recorded an unfair service agreement or notice or memo.
County clerk's office shall refuse to accept for recordation an unfair service agreement.
If county clerk accidentally records unfair service agreement, shall incur no liability.
If unfair service agreement is recorded, person with interest in the property may apply to court where record exists to record court order declaring agreement unenforceable.
Person with interest in real property may recover such actual damages, costs, attorney fees as may be proven against the service provider who recorded the agreement.
