HWI LEG Tenant Screening Fee Law


On Feb. 6, HWI LEG reported tenant screening fee law effective May 1.


  • HWI LEG reported that new tenant screening fee law will take effect on May 1, 2024.
  • Prohibited landlord from charging an applicant for a residential dwelling unit, a tenant screening fee that is more than actual cost to obtain information about the applicant.
  • Tenant Screening Fee
  • Act 200 (HWI LEG 521-46) prohibits tenant screening fee to be more than actual cost.
  • Landlords must refund tenant any fees not used for authorized costs within 30 days.
  • Fee can only be charged at time the application is processed and may only be charged to an adult 18 years and older or an emancipated minor who is applying to rent unit.
  • Also, provided FAQs for tenant screening fees; will be disseminated to stakeholders.
