NJ LEG Infertility Treatment Coverage


On Jan. 12, NJ LEG approved bill on insurance coverage for infertility.


  • NJ LEG approved Bill AB 5235/SB 3627 on health insurance coverage to treat infertility.
  • Bill provisions required that certain health insurance carriers cover infertility services for a partner of a person who has successfully reversed a voluntary sterilization.

  • Some private sector insurers who provide pregnancy-related coverage to more than 50 people, State and schools, must provide coverage for any infertility-related services.
  • Covers in vitro fertilization, intrauterine insemination, genetic testing, embryo transfer.
  • Required coverage to reverse voluntary sterilization, and infertility, as defined, must not be used to deny treatment/coverage due to relationship status/sexual orientation.
  • Also prohibited health insurance carriers from imposing restrictions based on age.

  • Act will take effect on the first day of the seventh month following enactment date.
  • The Act will also apply to contracts issued or renewed on or after the effective date.
