ALSK LEG Real Estate Commission proposed to update Alaska administrative code regulations, relating to certain forms that have been adopted by reference.
Comments regarding updates to real estate forms must be received by Dec. 8, 2023.
Jun. 2024 ALSK LEG Supplemental Proposal
On Jun. 13, 2024, ALSK LEG issued a supplemental notice announcing it updated the proposed forms, therefore updating the proposed regulations to note new changes.
Updates the date for the Alaska Real Estate Commission consumer disclosure form and waiver of right to be represented that the Commission has adopted by reference.
Two forms added to the Residential real property transfer disclosure statement form.
Adds Residential real property transfer disclosure statement - exemption for first sale.
Also Residential real property transfer disclosure statement - waiver by agreement.
Updates language to include both statutory definitions of residential real property.
Comments on proposal must be received not later than 4:30 p.m. on Jun. 24, 2024.
Aug. 2024 ALSK LEG Final Rules
On Aug. 22, 2024, ALSK LEG reported the amendments to ALSK LEG 12.64 were approved, signed and filed by the Lieutenant Governor for effect on Sep. 20, 2024.
Regulations concern updates dealing with the consumer disclosure form, the waiver of right to be represented form, and the property disclosure form, adopted by reference.
Along with updating existing consumer forms and adopting by reference additional forms, the regulations also amend the definition of residential real property.
Final version of the rules incorporates conforming technical corrections into the text.
