On Mar. 27, UTA LEG enacted bill re pharmacists, health benefit plans.

  • UTA LEG approved Bill SB 312 re pharmacy practices; adds new Sec. 662 in UTA INS 31A-22-66 to recognize pharmacists as health care providers in limited circumstances.
  • Bill Provisions
  • Insurer that provides a health benefit plan shall consider a pharmacist as a healthcare provider for a consultation that is provided to an enrollee re certain prescriptions.
  • If prescribing a nebulizer, a spacer, or a diabetic supply; or certain prescription drugs.
  • Would apply only if the health benefit plan covers the prescription drug or device.
  • Applies to a health benefit plan renewed or entered into on or after January 1, 2026.
  • Amends UTA LEG 58-17b-6-610.8 and UTA LEG 58-17b-6-622 re prescriptions for devices to ensure apt delivery; advanced written notice for audit of pharmacy records.
