On Nov. 18, LTH PRL registered bill on amendments to Law XI-1253.
LTH PRL registered bill XVP-1013 on amendments to Law XI-1253 on consumer credit.
This bill, and XVP-1014, were prepared to transpose into national law Dir 2023/2225.
Specific details of the reasoning for them is presented in accompanying memorandum.
The amendments impact, mainly, on art 25: Requirements for peer-to-peer lending.
When lender is natural person, total of consumer credits granted and not repaid to one consumer credit recipient on 1 peer-to-peer lending platform may not exceed €1,000.
Compliance with requirement set out in paragraph 1 of this article on a peer-to-peer lending platform must be ensured by operator of that peer-to-peer lending platform.
However, other aspects of the same article are punctually amended e.g. percentage of remuneration paid to operator of peer-to-peer lending platform by the lender and requirement for payment of remuneration.
The bill article 3 includes the new version of the Law XI-1253 on Consumer Credit.
The current draft has no express prospective entry into force date.
