On Sep. 13, CZC GVT provided a status update on the property bill.
CZC GVT confirmed the Chamber of Deputies approved, in the second reading, amendments to Act 219/2000 Coll., on the property of the Czech Republic and its representation in legal relations, as amended, and certain other acts.
Bill Overview
Amendments will simplify/clarify the process of transferring unnecessary real estate between the state and territorial self-governing units (municipalities and regions).
New legislation will ensure that municipalities and regions are informed about planned alienation of unnecessary property on territory and will facilitate transfer if they wish.
Territorial self-governing units will be entitled to transfer of immovable property defined for consideration or free of charge; law will clearly determine which real estate will be transferred free of charge and which at usual price under the Property valuation act.
Road land under local roads or land for public burial grounds will be transferred free of charge, while other real estate will be sold to local authorities at the usual price.
Introduces the possibility of reverse transfers, where territorial self-governing units will be able to transfer unnecessary property to the state under similar conditions.
Promote economical use of public property; also unifies approval of immovable property registered in Land Registry, which will be carried out by Ministry of Finance.
Another significant change is the formalization of the obligation for territorial self-governing units to notify the state about planned transfers of specifically defined properties, which the state can claim if it chooses to do so.
