  • EO authorizes attorney general to prevent large-scale transfer of Americans’ personal data to countries of concern and provides safeguards around other activities.
  • DoJ to issue regulations that establish clear protections for Americans’ sensitive personal data from access and exploitation by countries of concern.
  • Protections will extend to genomic, biometric, personal health, geolocation, and financial data, certain kinds of personal identifiers, will prevent large-scale transfers.
  • The DoJ will issue regulations establishing greater protection of sensitive government-related data, including geolocation information on sensitive government sites, military.
  • DoJ, Department of Homeland Security to work together to set high security standards to prevent access by countries of concern to data through other commercial means.

  • EO Timelines
  • Within 120 days, AG, Secretary of Homeland Security to recommend to APNSA appropriate actions to detect, assess, mitigate national security risks from transfers.
  • After 150 days, APNSA to review the recommendations and consult with relevant agencies on implementing the recommendations consistent with applicable law.
  • Within 1 year, AG must submit a report to the President through the APNSA effectiveness of the measures under EO, economic impact of EO implementation.
