SWI GVT amended ordinance OEmol-LCart on fees re the Cartel Act (LCart/WEKO).
Purpose
SWI COMCO enforces the LCart and parties are charged fees according to causality.
Anyone who causes an administrative procedure or requests advice or other services pays a fee; in case of closing a procedure without action, fees are pro rata temporis.
The preliminary examination of a merger of companies is charged a flat rate, and is accompanied by a fee of CHF 5,000; however, this doesn't cover the workload incurred.
Therefore, the flat-rate fee for the preliminary examination of a merger of companies will be abolished and the fees will be also calculated based on the time spent for it.
Effectiveness
Amending ordinance enters into force on Jan. 1, 2025.
