POL GVT Labor Code & Civil Procedure Code

On Aug. 4, POL GVT issued amending labor and civil procedure codes.

  • POL GVT published Act Poz 1046/2026 of Jun. 19, 2026, on the amendment of Labour Code Act and Code of Civil Procedure Act.
  • Follows POL GVT Jan. 2026 issued labor code, company social benefit fund act, see #283048.
  • Main Provisions
  • Amendments made to Act of Jun. 26, 1974, Labour Code (Journal of Laws of 2025, items 277, 807, 1423 and 1661, and of 2026, items 25 and 473).
  • Expanded definition of discrimination (direct, by assumption/association, harassment).
  • Compensation for discrimination for a single violation amounts at least 1 times minimum wage in compensation or damages; repeated violations (same or multiple grounds, or multiple grounds at once), at least 3 times minimum wage.
  • Employees cannot be dismissed or treated unfavourably for asserting rights under employment law.
  • Minimum compensation for retaliation set at 1 times minimum wage; protection does not apply if the employee knew no violation had actually occurred.
  • Employee needs to make violation plausible; employer must prove no discrimination occurred.
  • Employers must prevent, detect, respond to discrimination; support affected employees.
  • Definition of mobbing (persistent harassment of an employee - repetitive, recurring or continuous conduct) expanded; manifestations include humiliation, intimidation, unjustified criticism, hampering work, isolating an employee from the team.
  • Ordering/encouraging others to harass counts as mobbing; intent not required, effect only matters.
  • Employers with at least 10 employees must set up written rules/procedures i.e., protection of employee dignity/interests; equal treatment/non-discrimination; anti-mobbing measures.
  • Effectiveness
  • Act enters into force 3 months after OG publication date, i.e., Nov. 4, 2026.
  • New rules on repeated discrimination and persistent harassment apply even to conduct that started before the Act came into force, if it continued afterwards.
  • Within 6 months of in force date of this Act, employers shall adapt work rules to requirements set out in Act or issue internal rules, per art 94(3)(a(1) of Act as amended.
  • Proceedings initiated and not concluded before date of entry into force of this Act shall be governed by provisions of the Act amended in art 2 in their previous wording.
