NH LEG Rental Application Fee Limits


On Jun. 14, NH LEG passed bill to limit rental application fees.


  • NH LEG passed HB 283 to limit the rental application fee charged by a landlord.
  • Amended NH LEG 540-A:3, prohibited landlord practices and security deposits.
  • Bill Provisions
  • Prior to collecting any fee as part of the rental application or renewal process, the landlord must clearly disclose, in writing to prospective tenants, the amount of the fee.
  • As well as requirement for a satisfactory criminal background and credit check, if any.
  • Must return any amount beyond actual costs of background check, credit check, and/or administrative costs if unit is not rented to applicant within 30 days of receipt.
