Also compliance with requirements of legal acts, declaration of consent of natural person seeking to administer insolvency of legal person/bankruptcy of natural person and compliance with requirements of legal acts.
Overview
Order adopted by Audit, Accounting, Asset Valuation and Insolvency Management Service under Ministry of Finance amends Order V4-37 of Mar. 15, 2024.
Re ensuring functioning of Insolvency Administrator Selection Program, internal control of compliance of said program with provisions of Insolvency Administrator Selection Rules and approval of the Consent-Declaration, changes title, declares point 2 invalid.
It also invalidates the Order V4-15 of Director of the mentioned service of Jan. 2020.
Recommends form of consent-declaration of compliance with requirements of legal acts of legal person seeking to administer insolvency process of legal person or bankruptcy process of natural person in order be used in restructuring process of legal persons.
Also in bankruptcy process of legal persons in out-of-court procedure, in bankruptcy process of natural persons, when candidacy of administrator of natural person proposed by natural person in case in art 4.5 Law on Bankruptcy of natural persons.
The latter, via submitting an application to court to initiate bankruptcy proceedings.
Effectiveness
Order enters into force on Mar. 1, 2025.
