On Oct. 17, ARG CNV proposed virtual asset service providers (VASPs)
ARG CNV issued, for public consultation, General Resolution 1025, applicable to VASPs.
Proposal was issued in accordance with new CNV powers granted by Law 27.739.
Annex I contains VASPs regulation changes and Annex II contains consultation form.
Background
In compliance with legal mandate that designates ARG CNV as the regulator of VASPs.
Established the action and conditions under which VASPs must provide their services.
Based on principles and conditions in Article 38 of Law 27.739, reforming Law 25.246.
Highlights
Established application of the Participatory Development of Standards procedure approved by Decree 1172/2003, inviting citizens to express opinions and/or proposals.
General Resolution 1025 introduced supplementary data presentation to that required by General Resolution 994 for registering individuals and legal entities in VASPs.
Established financial requirements applicable for activities in Article 4 bis, Law 25.246.
Applicable to activities such as information security policies, cybersecurity aspects.
As well as prudential conditions for custody of virtual assets, segregation of accounts.
Data on agreements entered into with third parties, issues re customer referencing.
Included regulations of conduct that must govern VASPs activity and other premises.
Consultation
Opinion and/or proposals must be submitted within 30 business days, Nov. 28, 2024.
Effectiveness
General Resolution 1025 comes into force two days after its official publication.
