On Jul. 30, MA LEG passed a bill that is on insurance claims.
MA LEG passed bill S.785 to establish protections for policyholders in Massachusetts.
Bill Provision
The bill prohibits property and casualty insurers, including non-admitted and surplus lines insurers, from restricting insureds’ ability to hire public insurance adjusters.
A public insurance adjuster is a professional who assists policyholders with claims.
The bill makes restrictive policy language automatically unenforceable and requires it to be removed from the policy entirely, while leaving all remaining policy terms intact.
Amends Chapter 176D of General Laws, which governs deceptive insurance practices.
In addition, the bill also classifies such policy clauses as unfair claims practices.
Together, these changes ensure insurers cannot block policyholders from seeking independent professional representation during the claims process.
They strengthen rights and create a more balanced process for resolving disputes.
