FIN MoJ issued Government decree on determining the amount of earned income for an injured party who was under 18 years of age when the injury occurred.
The decree repeals a previous decree (383/2024) covering the same subject.
Overview
Regulation establishes a euro amount based on average earned income of income earners which could be used as the presumed earned income of the injured party when determining compensation for loss of earnings under the Damages Act (412/1974).
Earned income in accordance with the regulation could be used as the basis for compensation for loss of earnings when the person who has permanently and completely lost working capacity due to personal injury suffered before age of 18.
Amount of earned income is: EUR 10,680 per year when the injured party has reached the age of 18; EUR 46,190 per year when the injured party has reached the age of 23.
EUR 55,910 per year when the injured party has reached the age of 35
Effectiveness
The regulation shall enter into force on Jul. 1, 2025, repeals regulation 383/2024.
Compensation determined before the entry into force of this regulation shall be subject to the provisions in force at the time of entry into force.
