On Mar. 11, NEB LEG enacted bill on qualification of benefit claims.

  • NEB LEG approved Bill LB 197, to change provisions relating to disqualification for benefits, claim determinations and redeterminations under Employment security law.
  • Amended Revised statutes NEB LEG 48-628.09, NEB LEG 48-630, NEB LEG 48-631.
  • Allows adjudication of unemployment claims through means other than adjudicator.
  • Further, allows reconsideration of benefits if audit finds error in original determination.
  • Benefit Claims Determination
  • Measure allowed the Nebraska Department of Labor to adjudicate claims for unemployment insurance benefits through other means than by a claim adjudicator.
  • Claims arising out of same alleged labor dispute may be considered at the same time.
  • A determination upon a claim filed will be made promptly by the department, with a statement on benefit amounts claimant is entitled to for the week of determination.
  • Redetermination upon a claim filed may be made by a representative designated by the commissioner, hereinafter referred to as adjudicator, with adjudicator conditions.
  • Applies if benefit accuracy measurement program review finds error in determination.
