COL INS proposed new Regulation 4-2-XX to establish requirements concerning Colorado option standardized health benefit plans in the small group market.
Carrier that is required to offer standardized plans in the small group market must offer both standardized and non-standardized plans at the time of solicitation or sale.
Carrier must offer all standardized plans available in the applicable county and may not limit number of standardized plans offered to small employers at time of sale.
Also, must offer standardized plans in the same manner and under the same solicitation or sale policies and restrictions as the carrier’s non-standardized plans.
May not limit producer’s ability to offer standardized plans and non-standardized plans at same time unless the carrier has the same solicitation or sale policy or restriction.
Non-standardized plans that are preferred provider organizations (PPOs) or exclusive provider organizations (EPOs) must also offer standardized plans that are PPOs, EPOs.

Comments on the proposed new regulation are due on Dec. 19, 2024 by 5:00pm.
Hearing scheduled for April. 15, 2025, comments must be submitted by Apr. 18, 2025.
