According to JER States, competitive and well-functioning markets help conditions for entrepreneurs and dynamic businesses to grow, which needs a regulatory framework.
It refers to this as supportive with light-touch, but can intervene effectively as needed.
This draft follows adoption by JER States Assembly in Nov. 2025, of the Competition Amendment (Jersey) Law 202-, which updates the Competition (Jersey) Law 2005.
Mergers and Acquisitions
In relation to mergers and acquisitions, the proposed changes seek to reduce administrative burden and costs for businesses, and allow better focus for authority.
Specifically, allowing Jersey Competition Regulatory Authority (JCRA) to better focus its limited resources, as well rules to focus on local competition with more certainty.
JER States believe this will give businesses more certainty, reduce administrative procedures, and require comments on the draft mergers and acquisitions order.
The draft order also introduces a new notification test based on local turnover.
This would replace the Competition (Mergers and Acquisitions) (Jersey) Order 2010.
