On Oct. 13, SWE FI issued regulations and general advice on lending.
SWI FI published its Regulations and general advice (FFFS 2026:31) on the activities associated with housing loans and some other types of loans provided to consumers.
Also included is SWE FI's Decision memorandum (26-1152) providing background.
Requirements Overview
Regulations and general advice apply to companies under supervision of SWE FI.
Specifically, those that operate credit granting, credit intermediation and advisory activities in accordance with (Act 2016:1024) Act (2016:1024) on mortgage lending activities, on activities with housing credits and certain other consumer credits.
Where applicable, provisions also apply to companies that apply for a permit to operate activities and, if application is granted, will be under the supervision of the SWE FI.
For foreign lenders who apply for permit to operate, or who operate housing loans in Sweden under Chapter 2, s7 of Act 2016:1024 on mortgages or other consumer loans.
Also for foreign credit intermediaries from a country in EEA who, on basis of Chapter 3, s6 of Act 2016:1024, operate activities with housing credits from a branch in Sweden.
If a licensed firm is to operate any housing loans under Act 2016:1024 and operates bridging loans, provisions in regulations and general advice apply to bridging loans.
Credit institutions, payment institutions and electronic money institutions do not need permit under new law, but are covered by parts and by regulations and general advice.
The regulations contain provisions on application for a permit to operate a mortgage lending business (Chapter 2), application for permission to operate with consumer credit other than housing credit (Chapter 3), and business requirements (Chapter 4).
Later chapters also cover ownership and management, knowledge and skills, liability insurance for credit intermediaries, requirement for certain applications, and reporting.
Effectiveness
These regulations and general advice enter into force on Nov. 20, 2026, and repeal the Regulations and general advice (FFFS 2016:29) on mortgage lending activities.
