If requested, Commissioner must help in developing form that outlines a pharmacy's rights to pharmacy benefits, pharmacy benefit managers (PBMs), health benefit plans.
A health benefit plan must ensure that each pharmaceutical manufacturer rebate is used exclusively to benefit enrollees using one or multiple of certain methods.
By passing down rebate to point of sale to offset enrollee's deductible or coinsurance.
Using rebate to reduce premiums paid by enrollee; or use rebate to enhance enrollee.
Health benefit plan may not prohibit, condition participation in one pharmacy network on participation in another; apply to plan renewed, entered into, or after Jul. 1, 2026.
