Aims to address discrepancies between requirements in NM INS 59A and NM INS 13.
Discrepancies revealed by inquiries on licensing of resident, nonresident adjusters.
Adjuster Licensing
Producer licensing bureau is updating, revising NM INS 13, including for discrepancies.
Given that State statute controls when administrative rule conflicts with a statute, the Bureau will be using statutory provisions in administering adjuster licensing rules.
Per statute, if resident State issued resident adjuster license, must obtain that license.
New Mexico will work with adjusters until Jan. 1, 2025 to meet these requirements.
If adjuster's State does not license them, may name a designated home State (DHS).
Fingerprints are required for residents only, adjusters that select New Mexico as DHS.
Non-Resident continuing education in resident/Reciprocal State requiring 24 hours.
Adjusters advised that any directive/explanatory statement contained in prior bulletin is repealed to extent any prior bulletin provides conflicting direction or explanation.
