  • GE BaFin published a new general decree on common equity tier (CET) 1 instruments.
  • Previous decree on CET1 instruments at cooperative banks limited until Dec. 31, 2023.
  • Follows GE BaFin Jan. 2023 issued general decree on CET1 instruments, see #158219.

  • In the version applicable from Jan. 1, 2024, shows conditions under which repayment of business assets due to terminated cooperative shares is approved in advance.
  • Applies exclusively to cooperative banks not subject to direct supervision by ECB.
  • Background to this are the requirements of Capital requirements regulation and supplementary delegated regs by EU CMSN for requirements for own resources.

  • The general decree is valid until the end of 2024.
