Proposed Amendments
Proposed to amend the definitions of the terms product and strategy in relation to filing of nonquantitative treatment limitation (NQTL) comparative analysis report.
Carriers must file comparative analysis for each product (instead of top 5 health plans) in the individual, small, and large group markets, for NQTLs selected by MD INS.
Separate analyses are required if processes, strategies, evidentiary standards, or factors differ between plans within a product; shall note exception and identify plan.
Carriers must submit data templates on/before Jul. 1, 2024, every 2 years thereafter.
Summary form must be made available to plan members and accessible to the public on the carrier’s website no later than 30 days following the due date of each report.

Comments on the proposed amendments must be submitted by Jun. 2, 2025.
