This bill permits person to file disclaimer with Secretary of State (SoS) if they believe personal identifying information (PII) was unlawfully used in business entity’s filing.
Permitted SOS to cancel business entity that does not update statement to remove PII.
Authorized SoS to cancel business entity if, following court order finding the entity’s filing unlawfully uses PII, the entity does not file an updated statement of information.
Permitted person who reasonably suspects their PII has been used unlawfully in business entity filing to, under penalty of perjury, for $30 fee, file disclaimer with SOS.
File disclaimer of proper authority claiming PII was unlawfully used in filing.
By expanding scope of crime of perjury, bill imposed state-mandated local program.
