OH LEG passed SB 162 to amend OH INS 3901.388 on health insurer recoupment from health care providers by shortening timeframe for payment and overpayment recovery.
Bill Provision
Provides that payments made by a third-party payer to a provider become final a year after payment is made, instead of two years, and may not be adjusted after that date.
Requires third-party payer to start overpayment recovery process within one year after payment was made to provider, before seeking to recover the alleged overpayment.
Payer must give the provider written notice explaining the overpayment determination, including the beneficiary name, service dates, amount, claim number, basis, payment.
Providers must also be allowed to appeal without a fee and have 60 days to respond.
If the provider does not respond, does not appeal, or the appeal is denied, the payer may recover overpayment through deductions from other payments owed to the provider.
Allows electronic overpayment notices when the payer and provider use an agreed electronic notification system and makes conflicting contract provision unenforceable.
