On Dec. 17, LUX CSSF issued UCI forms for NAV calculation errors.
LUX CSSF issued the UCI forms for the notification of errors and instances of non-compliance under Circular CSSF 24/856 on investor protection, introducing new errors.
To account for the new category of other errors introduced by Cir CSSF 24/856, LUX CSSF replaced the current notification forms in place under repealed Cir CSSF 02/77.
It also introduced a secure transmission channel for the notification forms via the eDesk platform or alternatively via automated submission via API (S3 protocol).
The implementation of new notification forms will follow a two-stage approach.
The first stage makes the new notification forms available in the pre-production environment (eDesk PREPROD platform) and accessible there after Jan. 1, 2025.
Forms available in the section UCI notification in accordance with Cir CSSF 24/856.
All advanced users of UCIs, IFMs and UCI administrators concerned by this notification form will receive an email to create an advanced user in the PREPROD environment.
During the second stage, starting on Jan. 1, 2025, the notification forms will be available in the PRODUCTION platform, to be submitted via the new channels.
A user guide will be published informing about the complete production procedure.
LUX CSSF acknowledges that the implementation of the new notification forms, along with the new transmission channels, can lead during the first three months to delays.
Effectiveness
The new Circular CSSF 24/856 entered into force on Jan. 1, 2025.
