Bill updated Colorado uniform fraudulent transfers act, renamed to Colorado voidable transactions act (act), changing fraudulent transfers to voidable transactions.
Proposed amendments to the act would make the act align better with uniform law on voidable transactions, and update some of the definitions and terminology in the act.
Bill sets out burdens of proof/evidentiary requirements for various claims as per act.
In addition, bill sets out which jurisdictional laws control certain types of claims based on the location of a debtor and makes numerous technical amendments in the act.
