On Oct. 11, NOR GVT issued changes to legal debts related rules.
NOR GVT issued FOR-2024-10-11-2452 of Oct. 10 on amendments to Reg 562/1989 to Debt Collection Act etc. and Reg 323/2022 on insurance contracts, both re legal debts.
Overview
Amended Reg 562/1989 §1-4 para 1: when a lawyer who has provided security per §5 Advocates Act, has professional management of collection, claimant may, as compensation for costs to collect claim, claim compensation (fees) cited in para 2.
That is, provided claimant does not at same time demand compensation in terms of fees for notifications pursuant to §1-2 cf. §1-3 , and debtor has missed the payment deadline in payment request creditor himself sent, cf. para 3, by more than 14 days.
Reg 323/2022 §13 para 2 now reads: undertakings established in Norway will, in contract, give insured right to entrust safeguarding of his interests to lawyer of own choice from time insured has right to demand intervention of insurer per contract.
By lawyer is meant any person who has right to provide legal aid according to art 1 of Directive 77/249, with additions in Annex VII of EEA Agreement.
To the extent that people other than lawyers are allowed to provide legal aid that is covered by the insurance, they are equated in this context with lawyers.
Caveat
FOR-2024-10-11-2457 issued on Oct. 10 on the same subject was left with no effect.

Ministry of Justice, Emergency Preparedness regulation effective on Jan. 1, 2025.
