On Apr. 8, 2025, UK GVT published the Environment act 2021 (commencement no. 10) regulations 2025 (StIn 2025/447), which brings into force specified sections of the act.
Section 98 (biodiversity gain as condition of planning permission) and paras 1 and 2 of Sch 14 (biodiversity gain as condition of planning permission) in force on May 1, 2025.
On Nov. 3, UK GVT commenced specific Environment act 2021 rules.
UK GVT issued the Environment Act 2021 (Commencement No. 7) Regulations 2023.
Follows UKP Nov. 2021 passed the Environment Act 2021(EA 2021), see #78172.
Commencement
Regulation 2 brings into force on Nov. 3, 2023 specified sections of the act.
Section 82 is commenced to enable regulations to be made under Water Industry Act 1991, s. 141DB; EA 2021, section 98 and schedule 14, part 1 commenced to enable regulations to be made under Town and Country Planning Act 1990, schedule 7A.
And to enable biodiversity metric in para. 4(1) of that schedule to be laid before UKP.
EA 2021, section is commenced for the limited purpose of making regulations which would make provision for and in relation to a biodiversity gain site register.
Regulation 3 brings into force on Nov. 30, 2023 section 115 of EA 2021.
Section 115 inserts new section 96A into the Highways Act 1980, which places a duty on local highway authorities in England to consult before felling street trees.
