  • On Feb. 14, 2025, TX INS published adoption of final rule on MVCPA in State register.
  • Removed (c) in response to comment, which required insurers file new/revised notice.
  • Commenter stated obligation unnecessary, burdensome, required substantial costs.
  • Insurers still update notice to reflect requirements, do not need file amended notice.
  • However, if notice language appears on declarations page/endorsement, insurer must file amended form for approval per Insurance code Ch. 2301, TX INS 10-I-2301.
  • Amendments made to MVCPA pass-through fee become effective on Apr. 30, 2025.

  • Rule amended to remove the $4 MVCPA fee amount; insurer must pay the MVCPA fee.
  • Updated notice that insurer must provide to policyholder when insurer seeks to recoup MVCPA fee; added fee helps to fund detection, prevention of catalytic converter thefts.
  • If insurer recoups fee from policyholder, insurer must file a new or revised notice.
  • Insurer not need to include actual fee amount in filed notice; may use a variable field.
