Reforms include update rest or breaks obligations, including to provide place to sit.
Suspension from work, as a disciplinary measure, may not exceed eight days.
The worker shall have the right to be heard before the suspension is imposed.
Decree enters into force in 180 calendar days after its publication, i.e., Jun. 17, 2025.
Follows Decree to end gender pay gap, which entered into force on Dec. 17, 2024.
On Dec. 17, MEX PRL published reforms to eradicate gender pay gap.
MEX PRL published Note 1254 and Note 1256 concerning reforms to the labor law.
Also, establish that maternal and paternal leave can be granted in case of adoption.
As of Dec. 17, the Decree that reforms and adds various provisions of the Federal Labor Law and the Federal Law of Workers in the Service of the State comes into force.
Highlights
In order to eradicate gender pay gap, grant maternal, paternal leave when adopting.
The document defines in Article 86 of the Federal Labor Law the obligation of the State to reduce gender pay gap and to promote actions to eradicate unequal pay practices.
The proposal is to add a second paragraph to Article 28 of the Federal Law on Workers in the Service of the State, to specify workers' right to permits in the case of adoption.
Any prior provisions that are in opposition to this Decree are repealed by it.
Effectiveness
Decree will enter into force on the day following its publication in the official gazette.
