Clarifications
The amendments to the law prohibit retail chains from holding suppliers liable for failure to deliver volumes of goods in excess of those agreed upon in the contract.
They will contribute to the development of the trade market, restoration of suppliers' rights to freedom of contract, and provision of consumers with goods at fair prices.
The regulator is currently receiving requests from market participants asking for clarification on certain issues regarding the application of the new regulation.
In addition, RUS CMP notes that when concluding framework contracts with open terms, the application of sanctions to the supplier for under delivery of goods will be possible only if the retail chain has received consent from him for each order.
RUS CMP notes that the parties may draw up a schedule indicating the terms and volumes of deliveries of specific batches of goods for the entire period of the contract.
In accordance with the new regulation, it is unacceptable to fine suppliers for failure to deliver orders if the supply contracts include clauses on the unconditional approval of the order by the supplier in any volume or on the approval of the order by silence.
