On Aug. 2, FR GVT set detailed rules implementing transposition of EU Consumer Credit Directive.
FR GVT issued Decree no. 2026-719 implementing two ordonnances of Sept. and Dec. 2025 that transposed EU Consumer Credit Directive 2023/2225 into French law.
Amends Consumer Code and applies to lenders, credit intermediaries, consumers, and supervisory authorities.
Follows FR GVT amended Decree 2026-105 on consumer credit, see #307417.
Overview
Lenders now required to document and retain (for the full duration of the credit and in compliance with GDPR) both the creditworthiness assessment procedures and the supporting data and documents on which those assessments are based.
New definition of borrowers 'experiencing financial difficulties' introduced for purposes of mandatory referral obligation: it covers consumers for whom the lender has identified a reportable payment incident qualifying for registration on FICP (the national credit incident register).
When such an incident is identified, lenders must proactively direct borrower to an independent debt advisory service, providing contact details for at least one such structure which may include a 'points conseil budget' accredited service.
Debt advisory services must meet strict independence standard: they must neither solicit nor accept instructions from any lender, credit intermediary, credit purchaser, or credit servicer; they must promptly disclose any circumstance that could affect their impartiality, and must not derive any financial advantage from their advisory activity.
Costs charged by debt advisory services may only cover operating expenses necessary to provide the service and must not impose an unnecessary burden on borrowers.
Further Information
Two distinct professional training regimes maintained: one for personnel distributing consumer credit (Chapter II of Code) and one for mortgage credit (Chapter III), with training programmes, duration, competency requirements defined separately for each.
Training for consumer credit distributors must include explanations on how to inform borrowers of right to access debt advisory services under new framework; employers must hold training certificates available for inspection by supervisory authorities.
Effectiveness
Decree enters into force on Nov. 20, 2026.
Existing contracts in force on Nov. 20, 2026 remain governed by prior rules; decree applies in full to overseas territories with relevant applicability tables updated accordingly.
