  • Follows DEN JST Aug. 2025 consulted on bill implementing Dir 2023/2225, #265788.
  • Overview
  • Executive Order on information to consumers about prices in banks sets requirements for what information Danish and foreign banks that operate in country, including via branches, must provide to consumers when they offer products to them.
  • Changes are due to implementation of revised Consumer Credit Directive, which will be implemented in Credit Agreements Act, Marketing Act, Consumer Loan Companies Act.
  • The amending order must be seen in context of the draft proposal for Act amending Credit Agreements Act, Marketing Act, Consumer Loans Act and various other acts (Implementation of revised Consumer Credit Directive), consulted on until Sep. 10.
  • Revised CCD is a total harmonization directive so rules in the executive order that are within its harmonized area can no longer be maintained.
  • This means, amending order changes the scope of the executive order, so that credit agreements are removed from the scope of the executive order.
  • Rules of current Executive Order overlap with arts 9 and 10 of CCD2, proposed to be implemented in Credit Agreements Act, Sections 7a and 7e in mentioned proposal.
  • Requirements that follow from arts 9-10 CCD2 are more comprehensive than what is required in Executive Order so total harmonization prevents rules in order to survive.
  • As result of change in scope of Executive Order, wording adjusted in several provisions.
  • Change in scope will mean that information on credit agreements will no longer be visible in price list, this is a consequence of art 9 of the CCD2.
  • Amending executive order removes rules on marketing of credit agreements in section 7(1)-3, as arts 7-8 CCD2 contain rules on marketing of credit agreements, which are proposed to be implemented in the Marketing Act in the mentioned proposal.
  • Key Changes
  • §1, subs. 1 amended: Executive Order applies to Danish and foreign banks that carry out business in this country, including via branches, when they offer deposit products, currency exchange and home loan agreements to consumers, cf. subsection 2.
  • Heading before §6 is amended to Information about bank's home loan agreements.
  • In §6, ss1, credit agreements is amended to home loan agreements, and credit type to home loan type; S6, ss1, n5 repealed, n6 will now become n5; further detail provided.
