NOR GVT issued regulations (FOR-2024-06-21-1166) which amend the regulations (FOR-2023-02-14-193) on the assessment of coercive fines and violation fines.
Summary
The amendments have been introduced by the Ministry of Children and Families.
Regulations provide rules on the assessment of coercive fines pursuant to certain acts.
Section 41 of the Marketing Act, Section 13 of the Transparency Act, Section 42 of the Marketing Act, Section 29 of the Right of Withdrawal Act, Section 52 of the Package Travel Act, Section 14 of the Transparency Act, Section 38c of the Contracts Act.
Section 20a of the E-Commerce Act, Section 61a of the Consumer Purchases Act, Section 3-55 of the Financial Contracts Act and Section 4A-5 of the Energy Act.
In the event of intentional or negligent violation, fines of up to 4% of the trader's annual turnover or up to NOK25mn may be imposed, whichever is higher.
Overall effect of the recent amendments are to add the reference re the Energy Act.
Effectiveness
The regulations enter into force on Jul. 1, 2024.
