On Apr. 23, UK GVT issued amendments to the trade remedies regs.
UK GVT published Trade remedies (amendment) regulations 2024 (StIn 2024/545).
These regulations amend the Trade remedies (dumping and subsidisation) (EU exit) regulations 2019 (StIn 2019/450) (Dumping and subsidization regulations).
As well as the Trade remedies (increase in imports causing serious injury to UK producers) (EU exit) regulations 2019 (StIn 2019/449) (the safeguards regulations).
Additionally, these regulations amend Trade remedies (reconsideration and appeals) (EU exit) regulations 2019 (StIn 2019/910) (reconsideration and appeals regulations).
Amendments
Part 2 makes amendments to Dumping and subsidization regulations concerning investigations into dumping/subsidization, and assessments, incl transition reviews.
Instances where Trade Remedies Authority (TRA) must consider giving options to Secretary of State as part of recommendation in dumping/subsidization investigation.
Part 3 makes minor amends to safeguards regulations; Part 4 makes consequential amendments to reconsideration and appeals regulations to extend statutory regime for reconsideration/appeals to decisions of Trade Remedies Authority, Secretary of State.
The changes made provide more flexibility and decision-making powers for Ministers.
Plus consequential amendments to trade remedies reconsideration, appeals process.
The changes made maintain Trade Remedies Authority’s expert independent role.
While giving Ministers greater power to look at wider public interest considerations and flexibility to make decisions balancing interests of UK producers/importers/consumers.

These regulations come into force on May 23, 2024.
