CAN GVT Temporary Foreign Workers

On Mar. 21, CAN GVT adjusted Temporary Foreign Worker Program.

  • CAN GVT tweaked temporary measures of Temporary Foreign Worker Program (TFW).
  • Considering the changing labor market conditions and declining job vacancies and a post-pandemic environment, CAN GVT is adjusting the TFW program and road map.
  • It is to be used only in cases where there are no workers that can fill the role in CAN.
  • Follows 2023 CAN GVT foreign worker program measures, see #186084, #181556.
  • Temporary Measures Amended
  • The TFW should still only be used when there are no workers to fill the role in CAN.
  • Measures include: New Labor Market Impact Assessments (LMIAs) will be valid for 6 months (a decrease from 12 months) to ensure accurate labor market needs.
  • All employers identified in the 2022 Workforce Solutions Road Map will have a reduction from 30% to 20% of their total workforce that can come in through the TFW.
  • Employers will need to explore every option before applying for an LMIA.
  • Including recruiting asylum seekers with valid work permits here in Canada.
  • In addition, as of Jan. 1, 2024, employers are required to annually review the wages of temporary foreign workers to ensure they reflect increases to prevailing wage rates.
  • Wage rates are based on the given occupation, region where work will be conducted.
  • Some time-limited measures under the TFW Program, Workforce Solutions Road Map will not be renewed and will end, earlier than anticipated on May 1, 2024.
  • Effectiveness
  • Modified measures will be effective May 1, 2024.
