Established emergency program for renegotiation of debts of individuals in default.
Amends Law no. 12.087 of Nov. 11, 2009; creditors interested in participating in Desenrola Brasil, see #169943, must formally request their acceptance into program.
They must also offer, alternatively or cumulatively discounts on program credits.
Also must offer exclusion of low value credits from the registers of defaulters.
Finally, exclude debts renegotiated via program from the registers of defaulters.
Oct. 2023 BRZ GVT Emergency Debt Program
On Oct. 3, 2023, BRZ GVT enacted Law 14.690 in order to establish the emergency program for renegotiating private debts of defaulting individuals, Desenrola Brasil.
Set standards to facilitate access to credit and mitigate the risk of default.
Those who may participate are debtors registered in defaulter registers.
Also creditors that are legal entities responsible for registering debtors in registers.
For example, financial institutions, public and utility service providers, retail companies
Service providers in general, e.g. individual micro-entrepreneurs, micro-enterprises.
Small companies referred to in Complementary Law 123 of 2006, and others.
Debtors interested in participating in Desenrola Brasil must join the Program.
Must pay off their debts with own resources or new credit from authorized agent.
Law comes into force on date of publication or 180 days for Article 30 provisions.
Dec. 2023 BRZ GVT Desenrola Brasil Extended
On Dec. 12, 2023, BRZ GVT published provisional Measure 1.199 to extend the duration of the emergency debt renegotiation program for defaulting individuals.
Extended date of contracting the new credit operation until Mar. 31, 2024.
Mar. 2024 BRZ GVT Desenrola Brasil Extended
On Mar. 27, 2024, BRZ GVT published Provisional Measure 1.211 to extend the duration of the emergency debt renegotiation program until May 20, 2024.
Apr. 2024 BRZ FEB Desenrola Brazil for Businesses
On Apr. 22, 2024, BRZ FEB reported on Desenrola program for small businesses.
Program called Desenrola Small Businesses, ProCred 360 and new Pronampe.
Debt renegotiation and subsidized credit aimed at individual microentrepreneurs (MEI).
ProCred 360, for example, will serve MEI who earn up to R$360,000 per year.
This number is equivalent to almost 70% of the total number of companies in Brazil.
Desenrola will enable the renegotiation of debts of SMEs that earn up to R$4.8 million.
