On Apr. 5, CYP SEC published form submission rules and guidance.
CYP SEC circular C563 outlined risk-based supervision framework (RBS-F) electronic submission of 2022 information, using RBSF-CIF form version 7 and issued guidance.
Follows CYP SEC Apr. 2022, issued rules on electronic submission, see #135706.
Summary
The form must be submitted by all CIFs that were authorized by Dec. 31, 2022, electronically via CYP SEC transaction reporting system (TRS) by May 26, 2023.
On submission, CIFs must review the feedback file, ensure any errors are addressed and corrected before digitally signing (Excel files only) and re-submit corrected form.
No additional information is requested in version 7 compared with version 6 of form.
CIFs can submit digitally signed form to the CYP SEC TRS system from Apr. 5, 2023.
Queries on completing form fields must be submitted in writing by May 19, 2023.
Failure to submit forms on time may lead to penalties as per section 37(5) CySEC Law.
Effectiveness
Forms must be submitted by May 26, 2023.
Apr. 2024 RBS-F Version 8
On Apr. 16, 2024, CYP SEC issued cir C632 re RBS-F e-submission of 2023 information.
Form's version 8 must be submitted by all CIFs that were authorized by Dec. 31, 2023 even if they haven't made use of their authorization; submission by May 24, 2024.
Help with submission steps is provided online; successful submission is followed by the reception of a NO ERROR indication feedback file; penalties if not submitted on time.
Section P is amended; sections D, G have a point added; added section Q re sanctions.
Queries on the completion of Form RBSF-CIF can be sent via mail by May 17, 2024.
Apr. 19, 2024 RBS-F Version 9
On Apr. 19, 2024, CYP SEC issued cir C634 re RBS-F e-submission of 2023 information.
Due to a validation error in section Validation Tests of Form RBSF-CIF, version 8, which may cause technical errors in the submission of the Form, the Form is now revised.
The revised version of Form RBSF-CIF, version 9, can be found in the appendix.
All CIFs are requested to use this revised version of the Form, in their submission.
The only amendment in the revised Form, is the correction of the validation test, in section Validation Tests, all other information of v 8 remain the same in version 9.
Due to the Form's revision, the submission deadline is extended until May 29, 2024.
