ILL LEG Prescription Inhaler Coverage

  • ILL LEG passed bill SB 3203, amends Insurance code for prescription inhaler coverage.
  • Amends ILL LEG 5-375-6.11 and ILL INS 215-5-356z.5 on required health benefits.
  • Bill Provisions
  • Provides that a health plan may not deny or limit coverage for prescription inhalers based upon any restriction on the number of days before inhaler refill may be obtained
  • Applies to group or individual policy of accident and health insurance or managed care plan issued on or before Dec. 31, 2025 that provides coverage for prescription drugs.
  • Health plan shall limit total amount that covered person is required to pay for inhaler.
  • Health plan may not charge over $25 per 30-day supply for inhaler after Jan. 1, 2026.
  • Limits total amount for all covered prescription inhalers not to exceed $50 per 30 days.
  • Provides that coverage for prescription inhalers shall not be subject to any deductible.
  • Health plan may reduce covered person's cost sharing to an amount less than the cap.
