On Apr. 4, UK GVT commenced provisions under regeneration act.
UK GVT published The planning act 2008 (commencement no. 8) and levelling-up and regeneration act 2023 (commencement no. 4 and transitional provisions) regulations 2024 (StIn 2024/452), and a note relating to earlier commencement orders.
Brings into force Planning act 2008; Levelling-up and regeneration act 2023 provisions.
Follows UKP Oct. 2023 passed Levelling-up and regeneration act 2023, see #189574.
Planning Act 2008
Section 196 (determination of procedure for certain proceedings), paras 1, 7, 8 and 10-14 of Sch 10 (procedure for certain proceedings) come into force on Apr. 25, 2024.
So far as they relate to any appeal under s. 195 of Town and country planning act 1990 (TCPA 1990 UK)) (appeals against refusal or failure to give decision on application) against a refusal, or failure to give a decision, of a local planning authority.
Levelling-up and Regeneration Act 2023
The following provisions come into force on Apr. 25, 2024: section 103 (temporary stop notices in relation to listed buildings); section 115 (time limits for enforcement).
Section 116 (duration of temporary stop notices); section 117 (enforcement warning notices) and section 118 (restriction on appeals against enforcement notices).
Plus, section 119 (undue delays in appeals); section 120 (penalties for non-compliance); section 122 (consultation before applying for planning permission).
Also, section 124 (powers as to form and content of planning applications).
Regulation 4 brings into force on Jul. 25, 2024 section 105 of the LURA 2023 (UK).
Regulations 5 to 9 contain transitional provisions relating to time limits for enforcement, duration of temporary stop notices, restrictions on appeals against enforcement notices, undue delays in appeals and penalties for non-compliance.
Effectiveness
PA 2008 (UK) provisions, certain provisions of LURA 2023 (UK) in force Apr. 25, 2024.
Section 105 of the LURA 2023 (UK) comes into force on Jul. 25, 2024.
Oct. 2025 Commencement No 5
On Oct. 14, 2024, UK GVT issued the Levelling-up and regeneration act 2023 (commencement no. 5 and transitional provision) regulations 2024 (StIn 2024/1000).
The provisions of LURA 2023 (UK) specified in reg 2 come into force on Nov, 1, 2024.
Those provisions are: section 237 (childcare: use of non-domestic premises), and Schedule 23 (use of non-domestic premises for childcare registration) as introduced by that section; and section 238 (childcare: number of providers).
