UK GVT Employment Tribunal Awards

  • UK GVT issued The trade union and labour relations (consolidation) act 1992 (amendment of schedule A2) order 2024 (StIn 2024/1272, which amends Schedule A2 to Trade union and labour relations (consolidation) act 1992 (TULR(C)A 1992 (UK)).

  • Instrument is related to Code of practice (dismissal and re-engagement) order 2024.
  • That order (StIn 2024/708) was made under section 204(3) of the 1992 Act in order to bring the code into effect; the code of practice came in to force on Jul. 18, 2024.
  • Instrument adds protective award for non-compliance with collective consultation requirements to sch A2 of Trade union and labour relations (consolidation) act 1992.
  • Where an employment tribunal is making a protective award under section 189, and it appears to the tribunal that the employer has unreasonably failed to comply with relevant code of practice, the tribunal may increase employee award by up to 25%.
  • Conversely, where it is the employee who has unreasonably failed to comply with the relevant code of practice, their award may be reduced by up to 25%.
  • Code of practice on dismissal and re-engagement will be a relevant code of practice for this purpose, where the proceedings relate to a matter to which the code applies.
  • Effectiveness
  • This instrument comes into force on Jan. 20, 2025.
